German court denies issuance of a German birth certificate

German court denies issuance of a German birth certificate to a child who was born in the U.S. by a married surrogate mother. The court explains that the only way for the German parents to become parents pursuant to German law is through an adoption process. Even the extracts from the birth register of the State of California and the birth certificate that indicates the Ger…man parents as parent of a live birth does not change this. Apart from the fact that some states of the United States legalize surrogacy, in contrast to Germany, these documents cannot override the applicable German law (Art. 19 Abs. 1 S. 1 EGBGB) and can therefore not establish German citizenship of the child pursuant to § 36 Abs. 1 S. 1 PStG.
